Precautionary measures in lieu of deprivation of liberty in the Venezuelan legal system

The objective of this research is to analyze the legal regime regarding precautionary measures to substitute the deprivation of liberty in Venezuela, in accordance with its principles. It is approached with the descriptive-documentary research strategy, based on the analytical method. The sources to collect the information serve three areas: constitutional, legal and doctrinal. The protection of the fundamental right to freedom requires the reinforced incorporation of the precepts of Criminal Law to the task of each interpreter of legal norms. The reality warrants raising the protection of citizens who could face the application of the rule contained in the Organic Code of Criminal Procedure in an arbitrary manner. Consequently, it is recommended to promote an education oriented towards respect for what is established in the norm, not only in that previously mentioned, but also in the various regulations, which allows promoting an environment that does not relate the right to liberty with impunity and that protects the rights inherent to human beings.
