Classification of criminal sanctions in the Ecuadorian legal system

The purpose of this study is to describe the types of criminal sanctions in the Ecuadorian legal system. There are two key aspects for the determination of criminal sanctions, on the one hand, the degree of injury to the legal rights affected and, on the other, the proportionality of the penalty applied. According to the Ecuadorian Comprehensive Criminal Organic Code, criminal sanctions refer to three types: prison sentences, non-custodial sentences, and restrictive sentences of property rights. Therefore, in response to the principle of proportionality, in the Ecuadorian internal order, a classification of criminal sanctions is stipulated, which includes limitation of the right to liberty, restriction of other rights such as: free transit, expression, participation, and restriction of property rights. The application of any of these penalties must always be the result of a fair, balanced process where the principles of due criminal process prevail. This study is descriptive documentary type, through the application of the analytical method. The main sources of information are bibliographical, basically represented in normative texts of constitutional and legal rank, as well as national and jurisprudential doctrines.
