A Philosophical Approach to Colombian and Venezuelan Constitutionalism as a Guarantee for the Protection of Fundamental Rights

This research adopts a qualitative, documentary approach with a bibliographic design. The scope of this study lies in offering a comparative analysis of the constitutional legal systems of both countries, focusing on the protection of fundamental rights. The main objective was to identify the strengths and limitations of each model, providing a critical foundation for reflecting on the implications of judicial independence and institutional design for the effective guarantee of rights. Among the main findings was that, in the Colombian case, the 1991 Constitution strengthened the protection of individual rights through tools such as the tutela action and the judicial activism of the Constitutional Court, although this does not in itself indicate challenges within its context. On the other hand, while the 1999 Venezuelan Constitution included a broad catalog of rights and mechanisms for their protection, potential political influence over the judicial system has limited its effective implementation. Based on the differences identified between the two models, it is concluded that judicial structures and political conditions directly influence the application and effectiveness of constitutional norms and the protection of fundamental rights.
