Constitutional and legal reflections in the Ecuadorian electoral law

The Ecuadorian Constitution provides that sovereignty resides in the peale, whose will be the basis of authority, exercised through the organs of public power and other forms of direct participation. To this end, the right of participation is recognized, manifested through various constitutionally regulated mechanisms. This study aims to analyze the main constitutional and legal precepts that support the electoral law in Ecuador. The research is descriptive, documentary type, based on the analytical method. The Ecuadorian electoral law can be defined as the set of norms and organisms that regulate and execute the necessary structure for the prevalence of the democratic system, through the guarantee of the means or mechanisms of participation in conditions of freedom and parity, supported by the principles of diversity, ideological pluralism, and equality. It is concluded that the electoral function refers to the regulation of the Ecuadorian electoral system and includes: electoral processes, electoral financing, electoral authority, electoral justice and political parties, expression of the vote and the transformation of those votes into a popularly elected position. This function is sustained in the rights of participation of the people, in principles, in organisms, to ensure the inclusion of thoughts and ideologies.
