Guiding principles of commercial law in Ecuador

In the field of Commercial Law in Ecuador, the guiding principles set forth in Article 3 of the Commercial Code are recognized: freedom of commercial activity, transparency, good faith, lawfulness of commercial activity, social and environmental responsibility, fair trade, gender equity, solidarity, cultural identity and respect for consumer rights. The objective of this research was to specify the scope of the guiding principles of commercial law in Ecuador. This is a documentary, descriptive-hermeneutic research, with an analytical approach. The recognition of guiding principles of Commercial Law allows the adaptation of its regulations to new paradigms related to the Good Living, in the understanding that the achievement of the same implies a set of duties on the part of the State, ranging from the guarantee of the rights of individuals, communities and nature, the production of goods and provision of services, to the promotion of economic activities through the structuring of a legal order and institutions in accordance with the Constitution of Ecuador. It is concluded that it is necessary to abide by the guiding principles of Commercial Law, since they are part of the whole structure of the order and institutions that give life to lawful economic activities.
